POPIA Section 18 Informed Consent Notice

Consent to process personal information in terms of the Protection of Personal Information Act, 4 of 2013 (POPIA).

Optivet (Pty) Ltd takes the protection of your personal information seriously. This notice explains how we collect, use, and safeguard the information you share with us under the Protection of Personal Information Act, 2013 (POPIA).

Introduction

Optirecruit (Pty) Ltd T/A Optivet (the "Company") is a company established and duly registered in accordance with the company laws of the Republic of South Africa.

In terms of the Protection of Personal Information Act 4 of 2013 ("POPIA"), everyone has the right to privacy, including the right to the lawful collection, retention, dissemination and use of one’s Personal Information.

To give effect to this right, the Company is under a duty to provide any person whose personal information is processed by it (a "data subject") with details pertaining to the use of and subsequent processing of that personal information, before such information is used or processed.

In accordance with this requirement, the Company sets out below: (a) the information being collected and the source thereof; (b) the purpose for which it is collected; (c) whether supply is voluntary or mandatory; (d) the consequences of failing to provide it; and (e) how the information will be used and shared.

Application

This privacy policy applies to all dealings with the Company — orally, in writing or electronically — and whether owned, established, used, hosted or accessed by data subjects, including clients, learners, employees and staff, contractors and service providers, and other third parties who may access the Company’s written records and/or electronic platforms.

It applies to data subjects who use the Company’s services, written records and electronic platforms, and to all processing of personal information as a result of such use — except where a separate POPIA policy has been issued for a specific service or product.

Accountability

The Company takes the privacy and protection of a data subject’s personal information very seriously and will only process it in accordance with POPIA and the terms of this privacy statement.

Where the Company provides any personal information to a responsible party or operator, that person will be required — as a condition of receiving it — to process it in accordance with POPIA and this statement.

The relevant data privacy principles relating to the processing of personal information (collection, handling, transfer, sharing, correction, storage, archiving and deletion) apply without exception, save where POPIA provides for such an exception.

Agreement to be bound and consent to process

By accessing or using the Company’s services, website, URLs, and/or when sending or receiving emails using any Company email address, the data subject:

• acknowledges that they have read and understood this Section 18 informed consent notice;

• agrees to be bound by, and to comply with, this notice and the privacy policy; and

• gives the Company consent to process and further process the required personal information in accordance with this notice.

Receipt, use and sharing of personal information

The Company will receive personal information when the data subject interacts with the Company, whether by physical, telephonic or electronic contact.

Purposes include: verifying details; providing requested information, products or services; employment applications; managing data subject information; general administration; legal or contractual purposes; improving product and service quality; detecting and preventing fraud and money laundering; recovering unpaid fees; debt collection; research, analytical and statistical purposes; customer profiling; identifying other products and services of interest; informing data subjects about Company products and services; and making information available to third parties where it protects or pursues the legitimate interests of the data subject, the Company or such third party.

The Company may share personal information with: (a) Company employees on a need-to-know basis; (b) carefully selected business partners on a need-to-know basis; (c) operators such as service providers and agents acting on its behalf under an operator agreement; and (d) Company clients such as recruitment agencies and other entities holding a paid subscription to advertise vacancies, where the data subject applied for or registered on a specific vacancy or profile.

The Company does not share personal information with any third parties not described above, unless legally obliged, for legal proceedings, for the pursuance or protection of legitimate interests, or for the prevention of fraud, loss, bribery or corruption — in each case taking reasonable measures to ensure recipients keep the information confidential and secure.

Where personal information is transferred across South African borders, the Company will ensure the recipient is bound by POPIA-equivalent obligations under binding corporate rules or binding agreements that provide an adequate level of protection.

Information quality, openness & data subject participation

The Company makes every effort to ensure the integrity and accuracy of personal information, but this may not always be possible. Data subjects accept responsibility for keeping their information up to date and must inform the Company of any changes — via the change-of-details form on the Company’s Data Privacy (POPI) page, or by request to the Company.

A data subject has a right of access to any personal information the Company holds and may ask the Company to correct any inaccuracies.

Security of personal data

The Company makes all reasonable efforts to keep data secure at all times but cannot guarantee the security of information provided to or by it, and cannot be held responsible for any loss, unauthorised use or interception of transmitted information.

The Company website may contain links to other websites outside the Company’s control. The Company is not responsible for the content, privacy or security of those third-party websites.

The Company places cookies on its website to help improve the experience. Cookie settings may be changed via the relevant browser settings; if unchanged, the Company will accept that you are happy for these cookies to access your details.

The Company may use social plug-ins of networks such as Facebook, YouTube, LinkedIn and Twitter. The Company has no influence or control over data retrieved by these interfaces and is not responsible for any processing or use of personal information transmitted via them.

Telephone calls may be recorded and/or monitored for security and quality-assessment purposes.

The Company has implemented appropriate technical and organisational security measures to protect personal data against unauthorised access, accidental or wilful manipulation, loss or destruction.

Information being collected and the supply thereof

We only collect the information you provide to us.

We may request information from time to time, and by providing it you consent to its processing in terms of this privacy statement.

A refusal or failure to provide requested information may impact the quality and extent of the service we provide.

All information is provided voluntarily by data subjects but is mandatory for the performance of our services.
